Terms and Conditions for Videography & Photography Services

Please read these Terms and Conditions ("Agreement") carefully before using the videography and photography services provided by Ice Eye Media Ltd. This Agreement sets forth the legally binding terms and conditions for the use of our services. By engaging our services, you agree to be bound by these terms and conditions. If you do not agree with any part of this Agreement, please do not use our services.

1. Services Provided: a. Ice Eye Media Ltd specializes in providing videography and photography services for various occasions, including but not limited to weddings, events, portraits, and commercial projects. b. The specific details of the services, including date, time, location, and deliverables, will be agreed upon by both parties in a separate agreement or contract.

2. Booking and Payments: a. To secure our services for a specific date and time, a non-refundable deposit is required. The deposit amount will be communicated to you at the time of booking. b. The remaining balance is due on or before the day of the event or as specified in the contract. c. Payments can be made through the specified payment methods agreed upon by both parties. d. Additional charges, such as travel expenses or overtime fees, may apply and will be discussed and agreed upon before the event.

3. Cancellations and Rescheduling: a. In the event of a cancellation or rescheduling by the client, the non-refundable deposit will be forfeited. b. If the cancellation or rescheduling occurs within a specified period (as agreed upon in the contract), the client may be responsible for paying a percentage of the remaining balance. c. Ice Eye Media Ltd reserves the right to cancel or reschedule services due to unforeseen circumstances such as equipment failure, illness, or force majeure events. In such cases, all efforts will be made to provide alternative arrangements.

4. Intellectual Property: a. All intellectual property rights, including copyrights, remain with Ice Eye Media Ltd. The client is granted a personal, non-exclusive license to use and reproduce the delivered photographs and videos for personal use only, unless otherwise specified in a separate agreement. b. The client agrees not to edit or modify the delivered photographs and videos without prior written consent from Ice Eye Media Ltd.

5. Usage and Promotion: a. Ice Eye Media Ltd reserves the right to use the photographs and videos for promotional purposes, including but not limited to our website, social media platforms, portfolios, advertisements, and competitions. However, we respect your privacy and will not use any content that you request to keep private. b. If the client has specific privacy concerns or requests, they should inform Ice Eye Media Ltd in writing prior to the event.

6. Liability and Indemnity: a. Ice Eye Media Ltd will take utmost care and use professional skills in providing videography and photography services. However, in the event of unforeseen circumstances or technical failures, Ice Eye Media Ltd will not be held liable for any direct, indirect, or consequential damages. b. The client agrees to indemnify and hold Ice Eye Media Ltd harmless from any claims, losses, or expenses arising out of the use of our services, including but not limited to any copyright infringement or violation of privacy rights.

7. Governing Law and Jurisdiction: a. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles. b. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in United Kingdom.

8. Entire Agreement: This Agreement constitutes the entire agreement between Ice Eye Media Ltd and the client, superseding any prior agreements or understandings, written or verbal, relating to the subject matter herein.

9. Timeframes and Delays: a. The estimated timeframe provided for project completion is only an estimate and may be subject to change. b. Ice Eye Media Ltd will make reasonable efforts to complete the project within the estimated timeframe or any mutually agreed-upon deadline. c. Delays in project completion due to factors beyond Ice Eye Media Ltd's control, including but not limited to client-requested changes, non-cooperation, or unforeseen circumstances, shall not entitle the client to a refund. d. Ice Eye Media Ltd shall not be held liable for any damages or losses incurred by the client due to project delays.
